Imke Tuma-Koch studied law at the University of Osnabrück (2009-2014) as a scholarship student of the German Academic Scholarship Foundation and a student assistant at the chair of Professor Schulte-Nölke (Civil law, European Private- and Economic Law, Comparative Law and European legal History). After her first State Examination in 2014 (Schindhelm-Award, honored by the Ministry of Justice of Lower Saxony), she worked as a researcher and PhD student at the European Legal Studies Institute and taught law in Osnabrück and Bremen. From 2018-2020 she was legal trainee at the Higher Regional Court of Oldenburg (Second State Examination in 2020). »The Special Status of Animals in Private Law«

The thesis analyses the special status of animals in German private law with a new, overarching approach - by evaluating the impact of two key issues: on the one hand the emotional bond between humans and their pets and on the other hand animal welfare. It contains a comprehensive examination of animal case law, supplemented by comparative remarks. It also criticizes the inconsistent dealing with the two factors and develops proposals for a more objective and transparent application.Die Arbeit untersucht die zivilrechtliche Sonderstellung von Tieren mit einem erstmals übergreifenden Erklärungsansatz. Ihre zentrale These ist, dass sich tierspezifische Besonderheiten in der Rechtsanwendung vielfach auf zwei – bislang kaum konsequent unterschiedene – Schutzgüter zurückführen lassen: Das Affektionsinteresse des Menschen am Tier und das »Tierwohl«. Der bestimmende Einfluss der beiden Aspekte wird durch eine umfassende Bestandsaufnahme und Analyse von Rechtsprechung und Schrifttum zu »Tier-Fällen« an Beispielen etwa aus dem Kauf-, Miet-, Nachbar-, Fund-, Schadens-, Familien- oder Vollstreckungsrecht aufgezeigt und im Kontext der jeweiligen Rechtsgebiete bewertet; ergänzt durch rechtsvergleichende Blicke, v.a. auf Österreich, die Schweiz, Portugal, Frankreich und die USA.
